Is this your first arrest? Criminal cases can be terrifying and confusing, but if this is your first case, you may be eligible for an opportunity to have your case automatically dismissed.

Depending on the County your case is in, Pre-Trial Diversion, (PTD), Deferred Prosecution, or Pre-Trial Intervention can be available to you.  These programs are managed by the State Attorney's Office or State of Florida and are aimed at giving first-time offenders a second chance to keep a clean record. If you qualify, you will be asked to complete some conditions. Once completed, your case will be dismissed.


Who Qualifies?

Although requirements vary by county, the general qualifications for diversion include:

  • No prior arrests or criminal charges for similar offenses
  • Current charge is a misdemeanor or 3rd degree non-violent felony
  • U.S. Citizenship
  • Some programs require you to live in Florida/the county of arrest
  • Ability to pay restitution, if applicable


Additional factors may be taken into consideration. If there is a victim involved, they usually must give permission
for you to complete the program. If you are charged with a DUI, you may not be eligible based on your breath test
​results or if a crash was involved.


What are the Conditions?

The conditions of the program vary by charge, but most charges require:​

  • Enrollment into the program for 3-12 months, depending on the charge
  • Payment for the cost of the program, cost of prosecution, restitution, and possible fines
  • Community Service
  • Classes such as Anger Management, Impulse Control, or Batterer's Intervention Program, depending on the charge
